Senator John Thune issued the following comments on President Bush's nomination of Marty Jackley of Rapid City to serve as United States Attorney for the District of South Dakota:
"I think Marty will be an excellent U.S. Attorney," Thune said. "He has extensive experience in civil and criminal law, and is well known and respected in the South Dakota legal community. I am confident that he has the knowledge and experience necessary to lead the U.S. Attorney's Office in its critically important work."
Jackley is a partner in the law firm of Gunderson, Palmer, Goodsell & Nelson located in Rapid City. Beginning in 2001, he has served as a Special Assistant Attorney General in Meade, Butte, Fall River, and Custer Counties. He has also worked as a licensed attorney in the Oglala Sioux Tribal Court and as a Criminal Justice Act attorney, providing representation to tribal members and officers in federal court.
Jackley received his bachelor's degree in electrical engineering from the South Dakota School of Mines and Technology, and received his law degree from the University of South Dakota School of Law. He then served for two years as a federal law clerk for then-Chief Judge Richard Battey in federal district court in Rapid City.
Jackley currently serves as Chairman of the State Criminal Jury Pattern Instruction Committee, which works with prosecutors, defense counsel, and judges in the continued development of pattern jury instructions for use in courtrooms across South Dakota. He is licensed to practice law in the United States Supreme Court, the Eighth Circuit Court of Appeals, the Federal District Court in South Dakota, and South Dakota and Minnesota state courts.
The U.S. Attorney position was held by James McMahon until 2005, and since that time has been filled on an interim basis by Michelle Tapken and Steve Mullins. "Both Michelle Tapken and Steve Mullins have done a great job holding this position on a temporary basis until the nomination process was complete, and I thank them for their distinguished service," Thune said.
The U.S. Attorney's Office, which has regional offices in Sioux Falls, Rapid City, and Pierre, prosecutes federal crimes occurring in South Dakota and represents the United States in civil litigation in the federal courts. The President's nomination must be confirmed by the United States Senate.
